


{"id":1169,"date":"2024-06-06T12:11:23","date_gmt":"2024-06-06T11:11:23","guid":{"rendered":"https:\/\/lasanclas-ibiza.com\/blog\/en\/?p=1169"},"modified":"2024-07-18T12:24:19","modified_gmt":"2024-07-18T11:24:19","slug":"new-law-to-legalise-properties-on-rural-land-on-ibiza","status":"publish","type":"post","link":"https:\/\/lasanclas-ibiza.com\/blog\/en\/new-law-to-legalise-properties-on-rural-land-on-ibiza\/","title":{"rendered":"New law to legalise properties 2024 on rural land on Ibiza"},"content":{"rendered":"\n<!-- Facebook Like Button Vivacity Infotech BEGIN -->\n<div class=\"fb-like\" data-href=\"https:\/\/lasanclas-ibiza.com\/blog\/en\/new-law-to-legalise-properties-on-rural-land-on-ibiza\/\" data-layout=\"button_count\" data-action=\"like\" data-show-faces=\"false\" data-size=\"small\" data-width=\"450\" data-share=\"1\" ><\/div>\n<!-- Facebook Like Button Vivacity Infotech END -->\n\n<p>The new government has approved a decree law, Decree Law 3\/2024, of 24 May to allow the <strong>legalisation of irregularities<\/strong> of buildings, constructions, installations and uses <strong>on rural land that are time-barred<\/strong>, i.e. on which the administration can no longer act.&nbsp;&nbsp;<\/p>\n\n\n\n<p>This will allow the regularisation of buildings, constructions, installations and uses that were built without planning permission or that are out of order, on which any type of infraction and sanction has already expired, i.e. constructions that are <strong>more than 8 years old<\/strong>, counting from the entry into force of this decree.&nbsp;&nbsp;<\/p>\n\n\n\n<p>This also includes extensions, swimming pools or porches.&nbsp;<\/p>\n\n\n\n<p>The owners will have a <strong>maximum of 3 years<\/strong> to do so and will have to pay the same <strong>fees and taxes<\/strong> as if it were a new construction, as well as a <strong>penalty <\/strong>on the value of the work to be legalised.&nbsp;<br>&nbsp;<br>This penalty will be:&nbsp;<\/p>\n\n\n\n<p>&#8211; <strong>10%<\/strong> of the value if it is regularised during the <strong>first year<\/strong> of validity of the decree.\u00a0<br>&#8211; <strong>12.5%<\/strong> of the value if it is regularised during the <strong>second year<\/strong> of validity of the decree.\u00a0<br>&#8211; <strong>15%<\/strong> of the value if it is regularised during the <strong>third year<\/strong> of validity of the decree.\u00a0<\/p>\n\n\n\n<p>There will be bonuses for incomes below 33.000\u20ac per year of 50% and 25% for incomes up to 52.800\u20ac per year.\u00a0<\/p>\n\n\n\n<p>It is very important to note that such dwellings that will benefit from this regularisation will <strong>never be able to apply for a tourist rental licence<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>Excluded<\/strong> from this possibility of legalisation are agrotourism and rural hotels with illegal constructions, constructions in areas of public domain or expropriation.&nbsp;<\/p>\n\n\n\n<p>In case of being located on <strong>protected rural land<\/strong> (ANEI), only those constructions built before the entry into force of the Law on Land Management and Use of 29 May 2014 and must be prior to 10 March 1991 if the land is included in the scope of the Law on Natural Spaces.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Once this 3-year period has expired, the irregularities can no longer be legalised. \u00a0<\/p>\n\n\n\n<p>Therefore, it is a great opportunity that will <strong>increase the value<\/strong> of the property, which will benefit from having all the papers in order with the administration and will undoubtedly <strong>speed up the sale<\/strong> process for buyers.<\/p>\n<div class=\"signature\">\r\n    <div class=\"blg\"><a href=\"https:\/\/lasanclas-ibiza.com\/en\/imprint\">All information is supplied without liability!<\/a><\/div>\r\n    <a href=\"https:\/\/lasanclas-ibiza.com\/en\/\"><img decoding=\"async\" class=\"alignnone size-large wp-image-385\" alt=\"\" src=\"https:\/\/lasanclas-ibiza.com\/blog\/wp-content\/uploads\/blogsign.png\" \/><\/a>\r\n    <\/div>","protected":false},"excerpt":{"rendered":"<p>The new government has approved a decree law, Decree Law 3\/2024, of 24 May to allow the legalisation of irregularities of buildings, constructions, installations and uses on rural land that are time-barred, i.e. on which the administration can no longer act.&nbsp;&nbsp;
